Terms and Conditions

1. Definitions For purposes of these terms and conditions, the following definitions shall apply:

  • “Service Provider”: Customs Care B.V.
  • “Client”: Every natural person or legal person who uses the services of Customs Care B.V.
  • “Services”: All activities, in whatever form, performed by Customs Care B.V. for or on behalf of Client.

2. Applicability These general conditions apply to all offers, agreements and deliveries of services or goods by or on behalf of Customs Care B.V.

3. Offers and tenders All offers and tenders of Customs Care B.V. are without obligation, unless the offer contains an acceptance term.

4. Execution of the services Customs Care B.V. will make an effort to execute the services with care, striving for a good and careful result. However, the service is a best-efforts obligation unless expressly agreed otherwise.

5. Customs Documentation and Compliance The Customer is responsible at all times for the accuracy and completeness of all customs documentation. Customs Care B.V. is not liable for delays or fines resulting from incorrect or incomplete information provided by Customer.

6. Rates and payment The rates used by Customs Care B.V. for the services offered are exclusive of VAT and other government levies. Invoices must be paid within 14 days of invoice date, unless otherwise agreed.

7. Liability The liability of Customs Care B.V. for damage resulting from or in connection with the execution of a contract is always limited to the amount paid out in the case concerned under the applicable liability insurance.

8. Force Majeure Customs Care B.V. is not obliged to comply with any obligation towards Client if she is hindered to do so as a result of a circumstance which cannot be blamed on her fault, and which is not to be blamed on her by virtue of the law, a juristic act or generally accepted views.

9. Intellectual property All intellectual property rights and copyrights of ideas, concepts or (test) designs provided by Customs Care B.V. remain the property of Customs Care B.V., unless otherwise agreed upon.

10. Confidentiality Both parties are obliged to keep confidential all confidential information obtained from each other or from other sources in the context of their agreement.

11. Final provisions This agreement is governed by Dutch law. Disputes arising from this agreement will be submitted to the competent court in the Netherlands.
